Scope of Article

This article deals with the attempts of the parties and arbitrators to define arbitrabiiity under the collective bargaining agreements between the New York City Board of Education and the United Federation of Teachers covering teachers ("the agreement"). It hopefully will be of interest to those engaged in drafting arbitration clauses, particularly in the public sector, and those trying to interpret them as arbitrator or advocate. The emphasis in the article is on those aspects of the rules that are different from those under the usual industrial union contract. The source materials for this article were 39 awards under the agreement made between July 6, 1964 and April 11, 1974, as well as the agreements themselves.
