With the expanding scope and use of alternative dispute resolution, the standards of ethics applicable to ADR are a matter of growing concern. Issues that must be confronted and resolved to maintain confidence in alternative methods of settling disputes include whether, or to what degree, distortion of facts is acceptable in negotiations, the neutral's obligation to remain impartial versus the desire for equity in settlements, whether a neutral should advise on questions of law, and the appropriate extent of confidentiality.

The author examines a wide range of topics relevant to ethics in dispute resolution, focusing on a variety of ADR techniques and the specific issues associated with each. Case law and practical trends are discussed to provide an overview of current concerns and responses to ethical dilemmas within the ADR community.
