PART I

A. Arbitration Laws

1. Please identify by title and date the principal laws and regulations governing (i) domestic and (ii) international arbitration in your State.

Arbitration is governed by the Algerian Code of Civil and Administrative Procedure (hereinafter “CCAP”). The most recent version of the code was implemented by Act No. 08-09 of 25 February 2008.

1. Articles 1006 to 1039 set out the general rules applicable to arbitration.

2. Articles 1039 to 1061 set out rules specifically applicable to international arbitration.

The rules governing international arbitration were first adopted through Legislative Decree No. 93-09 of 25 April 1993. They were only slightly amended by Act No. 08-09 which will be enforceable as of April 2009. Given the expected date of publication of the present document, and given the minor nature of the changes brought by Act No. 08-09, we have based our responses on the CCAP as it will be applied by April 2009.
