Pending before this Court is Petitioner, Mesa Power Group, LLC's ("Mesa Power") ex parte application for the issuance of a subpoena pursuant to 28 U.S.C. § 1782. Mesa Power seeks the issuance of a subpoena to Samsung C&T America, Inc, ("Samsung") which has its principal place of business in this district. The proposed subpoena seeks to obtain the production of documents and the taking of deposition from the president and treasurer of Samsung, Kyo In Choo and Jin Goo Kwon respectively. (Docket Entry No.1, Ex Parte Application ("App or Motion")). Mesa Power states that this information is highly relevant to an international arbitration concerning a renewable energy agreement between Samsung and the Government of Canada ("Canada").
