The topic of this presentation is “The expectation: how
important is enforcement in the choice of international

arbitration?” Now, as Doak Bishop mentioned, superficially we
have the New York Convention, which allows for the enforcement
of arbitration agreements and arbitration awards in as many as
145 countries. The reality, of course, is that it is much more
difficult and more complex, and in that context, how does
corporate counsel evaluate and manage arbitration risk and
enforcement risk? What input does outside counsel have in
dealing with enforcement risk?
With me today, we have a distinguished panel of experts. On
the far end of the table, we have Karl Hennessee, who is the Vice
President of Public Law & Technology for Halliburton. He is
currently the Chairman of the Governing Body of the ICC Court of
International Arbitration. Before Halliburton, he was the Vice
President of Litigation and Regulatory Affairs at Airbus. Karl
Hennessee has practiced and studied in both Europe and the U.S.,
and it is a bit of a homecoming for him today because he is a
graduate of Southern Methodist University Law School.
By videoconference, we have Gregory Odry, who is the
General Counsel of GDF Suez Energy Central America. Poor
Gregory Odry had his passport stolen just in the last day or so and
unfortunately cannot be with us in person, but he is so graciously
appearing from Panama by video. Gregory Odry is an expert in
international construction, operation, and maintenance contracts,
especially electricity and water services. Before GDF, he had been
in-house counsel at Electricité de France and Veolia Water.
