In the United States, parties to an arbitration increasingly are avoiding the party-appointed system because they believe it results in extra cost, delay and ambiguity. Some institutions, such as the reinsurance industry, continue to adhere to the party-appointed system- though there is a growing recognition of the problems stemming from such a process. This article maintains that the party-appointed system is a holdover from earlier times when administrative agencies were not available and suggests that "the additional costs and uncertainties of that process may no longer be appropriate."
