I. THE ARBITRATION CLAUSE AND THE ARBITRABLE ISSUE

UNINSURED MOTORIST ENDORSEMENT — ARBITRABILITY OF COVERAGE QUESTIONS — ILLINOIS

Questions of coverage including whether claimant is insured under policy, whether the other vehicle was actually uninsured, or whether there was a hit-and-run driver involved, are arbitrable under uninsured motorist endorsement. The court held that the arbitration paragraph of the endorsement "deals not with the liability of the uninsured motorist, but the liability of the company to pay under the contract." Therefore, coverage questions are a proper subject for arbitration. The court limited its own jurisdiction to determining whether or not a valid arbitration agreement existed. Flood T. Country Mutual Insurance Co., 232 N.E. 2d 32 (111. App. 1968).
