The present challenge of Mr. J. Christopher Thomas, QC arose in the case of Vito G. Gallo v. Government of Canada, which is being heard under the UNCITRAL Arbitration Rules and Section B of Chapter 11 of the North American Free Trade Agreement (“NAFTA”) by a three-member tribunal. The Tribunal consists of Mr. Juan Fernández-Armesto (presiding arbitrator), Mr. Jean-Gabriel Castel OC, QC, and Mr. J. Christopher Thomas, QC. The arbitral proceedings in this case are being administered by the Permanent Court of Arbitration (“PCA”).
