Managing ESI is vital to achieving a cost-effective arbitration. There is a legal duty to preserve relevant ESI in anticipation of arbitration and if requested, to produce it. The authors urge arbitrators and counsel to learn the technology of ESI-- arbitrators so that they can better manage ESI exchanges, and counsel so that they can cooperate in producing relevant, non-privileged ESI. The authots suggest helpful practices that counsel can employ to facilitate the ESI exchange.
