A. Arbitration Laws
1. Please identify by title and date the principal laws and regulations governing (i) domestic and (ii) international arbitration in your State.
Jordanian Law No. 31 of 2001 (the Law of Arbitration) governs every consensual arbitration held in Jordan. This law applies to arbitrations involving civil or commercial disputes between public persons such as government, ministries, official departments, or public authorities and private persons such individuals; corporate persons such as companies and societies.
2. Please provide an electronic link (i) to an English language translation of the laws and regulations identified in Question 1 above and (ii) to the Arabic text.
The Arabic text of the Jordanian Arbitration Law is found on the website www.adaleh.com. The English text of the Jordanian Arbitration Law is found on the website www.lac.com.jo.
3. Are any of the laws and regulations identified in Question 1 above based on the UNCITRAL Model Arbitration Law, including UNCITRAL’s Revised Articles? If so, is this expressly stated in the relevant laws and regulations?
The lawmakers who drafted the Jordanian Arbitration Law considered the UNCITRAL Model Arbitration Law, including the revised one, and it is one of the resources from which the Jordanian Arbitration Law was derived. However, we cannot consider the UNCITRAL model as the essential and sole source of the Jordanian Arbitration Law. There is no provision in the Arbitration Law that expressly refers to the UNCITRAL Model Arbitration Law.
