According to the note verbale of the Ministry of Foreign Affairs of the Russian Federation dated 18 September 2013 (Annex 2 of the Statement of Claim), “[o]n several previous occasions the ship’s crew have carried out activities that constituted a threat to the maritime safety of ships performing exploratory activities on the continental shelf in the Russian sector of the Arctic region”. Has there been any contact between the Russian Federation and the Netherlands as the flag State of the Arctic Sunrise in this respect and, if so, what was the action taken?
