I. BASIC INFORMATION
A. History and Background of the Institution
The Arbitration Court attached to the Czechoslovak Chamber of Commerce was founded in 1949. The government and specifically the Ministry of Foreign Commerce established the Arbitration Court with the power to settle disputes arising from foreign commercial disputes.
In 1980, its name was changed to the Arbitration Court attached to the Czechoslovak Chamber of Commerce and Industry. On 1 January 1995 the court assumed its current name, the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic (known also as the Czech Arbitration Court or “CAC”).
Since 1 January 1995, the CAC has also had jurisdiction to resolve domestic disputes.
The CAC is a permanent arbitration court pursuant to Act No. 216/1994 Coll., on Arbitration Proceedings and Enforcement of Arbitral Awards (“Czech Arbitration Act”). It operates as an independent arbitral body tasked with resolving disputes through the decisions of independent and impartial arbitrators. The Arbitration Court is an independent and self-managing institution.
The Rules of the Arbitration Court govern proceedings at the CAC. They first entered into force on 1 July 2012 (the “2012 Rules”) and were published in the Commercial Bulletin No. 23/12 on 6 June 2012. They were subsequently amended in 2015 and the amendments came into effect on 1 October 2015 (the “Rules” and the “2015 Rules”). The 2012 Rules replaced the: (a) Rules of the Arbitration Court, published in the Commercial Bulletin No. 51/94; (b) Rules of the Arbitration Court, published in the Commercial Bulletin No. 12/95; (c) Amendment of the Rules of the Arbitration Court and Amendment of the Rules on the Costs of Proceedings, published in the Commercial Bulletin No. 43/95; (d) Amendment to the Order of the Arbitration Court; (e) Order of the Arbitration Court, published in the Commercial Bulletin No. 30/98; (f) Annex No. 1 to the Rules on Costs of the Dispute; (g) Supplement No. 2 to the Rules and Rules on Costs of Arbitration for Domestic Disputes published in Commercial Bulletin No. 17/02; (h) Supplement No. 3 to the Rules of Procedure for the Domestic Disputes, published in the Commercial Bulletin No. 45/99; (i) Rules on the Costs of Arbitration, published in the Commercial Bulletin No. 5/07; and (j) List of Arbitration Costs - National Disputes as an Annex to the Rules on Arbitration Costs for Domestic Disputes published in Commercial Bulletin No. 17/11.
