Despite the voluntary nature of arbitration, the form of the proceedings may be out of the parties' control if their arbitration clause leaves open the questions of how, where, when, and before whom the arbitration is to proceed. This article discusses a number of issues that parties should address when drafting their arbitration clause, focusing on the large, complex case.

The author notes factors to be considered when providing for selection of arbitrators, scope of the clause, locale of the hearings, time frames, and procedural details, and concludes that a well-tailored arbitration clause can pave the way for a smooth arbitration. The author also explains how a preliminary hearing can help ensure that the arbitration moves forward expeditiously.
