1. The TPF market in Albania
1.1. Please shortly describe the TPF market in your Jurisdiction.
The Third-Party Funding practices in Albania are rare since the ADR practices per se are not that developed. While TPF is acknowledged, its prevalence is not as pronounced as in more established legal markets. The legal community and parties involved in disputes are becoming increasingly aware of the potential benefits and challenges associated with TPF.
1.2. Is it dominated by local or international Funders, which Funders are active? Which cases typically get funded?
The TPF market in Albania does not appear to be dominated by either local or international funders. The very limited activity suggests a mix of local and international players engaging in funding arrangements based on the specific needs and dynamics of the cases. Since arbitration disputes are confidential, to the best of our knowledge, TPF has been adopted in only two International Arbitration Disputes, i.e., an Investment Dispute under a BIT before ICSID and a commercial arbitration dispute under the ICC rules.
1.3. What types of funding exist (e.g., ISDS, Commercial Arbitration, portfolio funding, respondent-side funding etc.)?
As there is no statutory regulation for TPF, any type of funding can be arranged between the parties
